Fla. Supreme Court denies NCAA motion for a stay

TALLAHASSEE, Fla. (AP)—The NCAA’s bid to delay a court order to release its records on academic cheating at Florida State was rejected Tuesday by the Florida Supreme Court.

In a terse one-sentence order, the high court denied the NCAA’s emergency motion. However, that decision does not preclude them from considering the merits of the case later.

Attorneys for the NCAA provided the records to a Tallahassee law firm to prepare for release, although they aren’t expected to vary much from documents already made public by Florida State University. The school released copies earlier this month from “screen shots” of documents posted on a secure, read-only Web site, but not the originals.

The Associated Press and other media sought immediate release after an appelate court on Oct. 13 upheld an earlier ruling that the documents are public records. A circuit judge last week ordered the NCAA to release the documents by 2 p.m. Wednesday unless it could win a stay.

The AP sued to get the records on the college athletics governing body’s plan to strip coaches and athletes of wins in 10 sports.

Longtime football coach Bobby Bowden stands to lose 14 victories that would make it difficult for him to overtake Penn State’s Joe Paterno in their race to be major college football’s winningest coach. Paterno now leads with 390 victories to 385 for Bowden, who hopes to hang on long enough to reach 400.

“We thought it was an important case to take in the first place and we’re certainly happy with every step of the way so far,” media attorney Carol Jean LoCicero said Tuesday.

“We feel strongly that our private information should not be subject to public records laws,” NCAA spokeswoman Stacey Osburn said Tuesday. “This question still remains under review by the Florida Supreme Court and the NCAA will continue to seek all available remedies to protect this important principle.”

The records involve meetings between Florida State officials and the NCAA, which said 61 Seminole athletes, including 25 football players, cheated on an online test in a music history course from the fall of 2006 through summer 2007 or received improper help from staffers who provided them with answers to the exam and typed papers for them.

In response to a question during an October 2008 meeting with the NCAA, former Florida State academic adviser Brenda Monk said one athlete that she helped had an IQ of 60 and that at least one athlete couldn’t read.

Florida State, which itself reported the violations to the NCAA, accepted self-imposed penalties including loss of scholarships and player suspensions.

But the NCAA’s intent to take away wins and individual records, prompted Florida State University T.K. Wetherell to fight that part of the penalty.

    The NCAA is flat out silly. They are walking a tight rope right now. They make millions on the backs of "students" that get paid nothing for their services. If a kid doesn't step up and perform at a certain level, they don't teach them - they drive them out so the scholarship can go to someone else. The hypocrisy of the NCAA is clearly observed when it allows a school like Notre Dame to play as an "independent" and pick its own favorably schedule so it maximizes alumni input and donations and maximizes their chances to make it to a BCS game AND........negoiate their own TV contract.
    Last year I watched the final of the NCAA Womens softball tournament and each team had played like 75-80 games that year. How does a student go to school full time and play 40 games on the road? It explains why Tim Tebow can get by with a 1 credit semester this fall - but it follows the rules?????? Are they real students or does the NCAA turn a blind eye when universities invent nonsense majors with ridiculous classes where everyone gets a B - whether they show up or not? SOme student athlete that followed the rules for 4 years but kept a detailed logged about their classes should sue the NCAA for seting up a system that "pretends" to treat athletes like students..
    Some students at FSU cheated on a test. Student-athletes bring rules ALL the time at ALL schools. Remember the headline "Navy Midshipman Charged In Rape at Academy Dorm" or the SI story on the OT Tony Manadrich at Mich State and his excessive steriod use......or Reggie Bush and his parents financial gain at USC or ..........don't see NCAA taking away wins there. A couple of years ago FSU complained about a BB game against Duke in which ref's missed like 25 calls.........The NCAA is made up of upper middle class white people that live in a mostly white community. They have a tough time dealing with diverse schools. they seem to get more vindictive with the FSU's, Alabama's, etc than they do with a school one of the children might go to. Oh, by the way, FSU has had 3 Nobel Laureates in science work there........I think that is better than Duke or Wake or.......so temper the "dumb" labels.

    NCAA should have to be transparent, as should all schools participating in college athletics. Who is monitoring the NCAA? They, at the very least, appear to be corrupt. Perception is everything, so, what are they hiding? A lot of money runs through the NCAA, and a lot of high salaries are paid to NCAA employees. Just sayin'....... Boomer Sooner.

    I'm not and FSU fan, But, Coach Bowden has done alot of good things for football..At West Virginia.. He did the things for his arch rivals marshall.. After the place crash..Not only did he let them use his facilities. He even wore their/Marshall's jersey's at their last game of that year....And to use his name with the likes of Coach Bryant. Doesnt upset me..But then again, why should it??. He is from "BAMA" anyway how about cutting him some slack? The man has earned that much respect over the years. Besides Jimbo will get his chances some enuff !!!

    Notice in Bobby's interviews he never talks about what's best for the team, alumni and school. Face it...he's in it for himself and nobody else. I totally realized it a couple of years ago. In an interview he said he would rather die on a football field than on a golf course.

    But the guy is a Bear Bryant of the college football! yes he earn his wins and help these kids out ask most of his old team and looking at FSU people on NFL Network and on Football teams I think he help more people then his self!

    Bobby built what FSU is today and FSU is what he put his entire life into,why wouldn't he want to die on the field than the golf course??

    I can tell right now that most of you bashers have an IQ lower than 60 if you don't think that Academic cheating doesn't go on at every school,especially at uf! Heck,Timmy Tebow had a SAT score of 790!! How'd that dumbass get into college?

    I don't believe he's actively been head coach for years. Time for Bobby to do the right thing and announce his retirement at the end of the season. The press will miss his interviews, but that too will pass.
