Dr. Saturday - NCAAF

I'm a doctor, not a lawyer -- hell, I'm not really even a doctor -- so will someone with some credentials please clarify what is going on here:

MANHATTAN, Kan. (AP)—Kansas State has filed a lawsuit challenging a secret deal between former athletic director [Bob] Krause and former football coach Ron Prince that would pay Prince $3.2 million in deferred compensation between 2015 and 2020.

Kansas State president Jon Wefald said he found out about the deal on May 11 and that nobody in the administration or athletic department knew about it. The lawsuit seeks to invalidate the deal.

Krause resigned as AD in February, but the secret deal was only "inadvertently discovered" last week; Krause subsequently "resigned" today from his new gig, as director of development at KSU's campus in Olathe, Kan. From the outside, it seems entirely possible that he went out of his mind.

But his handiwork -- agreeing, by himself, to defer millions for nearly a full decade to a foundering, first-time head coach mere months before firing him -- is not going to be easy to resolve:

"After [associate AD] Jim Epps and I learned about the secret agreement, we spent several days explaining to Ron Prince and his agent why they should consider the agreement was null and void," [KSU president Jon] Wefald said in the statement. "That failed."

K-State's best hope is to convince a judge that negotiating without university lawyers constituted a breach of ethics. But even if that works, the Wildcats still have to reckon with this: Krause was the guy responsible for the decision to resurrect Bill Snyder in Prince's place last November, which suddenly goes from "unorthodox" to "stark raving mad."

    Doc, generally an AD cannot negotiate and ratify a contract without school administrative approval. Which would normally mean a "secret" deal is null and void. But, if the AD was given power to reach deals or if someone with approval authority endorsed the deal, even if school prez, board of trustees, etc. are otherwise unaware, then the school may be screwed. That can come down to an "implied authority" rule that most law students in America try to forget upon finishing their first Business Associations class. Personally, I think this only confirms that Kansas State may be the most pitiful program in the country. Even more than Auburn.
