Low offer hastened ex-Ky. coach’s decision to sue

LEXINGTON, Ky. (AP)—An attorney for former Kentucky basketball coach Billy Gillispie said Friday his client was reluctant to sue the school but decided he had no choice after receiving a settlement offer for less than one-sixth what he believed he was contractually owed.

Demetrious Anaipakos said in a phone interview that a $925,000 offer the university presented on May 1 was the only one the coach ever got after he was fired following two tumultuous seasons as the Wildcats’ coach.

“He wasn’t excited about suing anyone,” Anaipakos said. “He’s not a litigious person, but when considering that offer, he just determined the only way was to proceed to court.”

The two sides settled this week for what Anaipakos said was around $3.25 million, with more than $250,000 of that in attorneys’ fees.

Although Gillispie and the school never signed a formal contract, a memorandum of understanding indicated he would receive $1.5 million for each of the four years left on his contract if terminated. Gillispie argued that meant UK owed him $6 million, but the university countered the terms weren’t active because the formal employment agreement was never signed.

Anaipakos said he didn’t consider the agreement a “split the baby settlement” because Gillispie’s payout will come up front, rather than over a four-year period. In making the $925,000 offer, the university also suggested it would expire within days, he said.

In a statement confirming the settlement on Tuesday, the university said it would have no further comment. The agreement said the settlement was not an admission of liability and was made only to avoid further expense, controversy and litigation.

Anaipakos said it will also help free up Gillispie to pursue another coaching job.

“He’s much more comfortable on a basketball court than a court of law,” he said. “This allows him to focus his efforts on finding a program to do what he loves, which is coach college basketball. I expect he’ll be back coaching very soon.”

Gillispie filed the suit in federal court in Dallas, accusing the school’s athletics association of breach of contract and fraud. The school later countersued in Kentucky.

The former coach still has one legal matter pending in Kentucky. He faces a possible trial in February for a drunken-driving case following an Aug. 27 traffic stop in Lawrenceburg during which officers said they smelled alcohol on his breath.

His lawyer says Gillispie is weighing a plea deal in the case.

    #94 udahman - If the universities and the NCAA ever start giving the athletes a cut of the billions of dollars they bring in each year, then you may have a point. But until then, your point is bogus. The athletes earn millions for their universities. This more than offsets the cost of the scholarships. And another fact you need to know - The D1 basketball players are on 1 year scholarships. The university decides whether or not to renew them each year. Of course they usually do, but not always. So these athletes are already exploited and should have every right to leave early to pursue a professional career. No different than a student who is on an academic scholarship that decides to quit school and start a career, before they finish their degree. And they typically generated ZERO revenue for the university while they were there.

I have to ask, why in the hell were you stupid enough to return back to Kentucky, then be stupid enough to be out driving drunk???     I am loving this. You people get jealous much??? LOL. Let's see, UK has the best recruiting class in HISTORY and all the little tar heels and jay hawks are just dying over it. I LOVE IT!!! You can hate, and run your mouths all you want. The results are getting ready to speak for themselves.
    A new coach, let me reword that, the BEST coach in college basketball, the best recruiting class in college basketball history all at the BEST school in college basketball will make for a GREAT year. Can't wait til Coach Cal and the boys raise banner number 8 in the rafters at Rupp Arena!! Trust me, it will happen this year.

    Let the Kentucky "haters" hate, and watch the WINS pile up. If Billy G was good he would be hired by somebody, looks like he has a problem. Kentucky gave him more than he was worth and that will be his biggest pay off. Good coaches like Clem Haskins were ran out of the game; I agree that too many non basketball folks are getting the elite jobs. If that is the case too many deserving coaches are gettting over looked. How many coaches could have got away with what Rick Pitino did at Louisville, and still coaching??????

    Here is your answer $$$$$$$$$$, don't hate on Kentucky for paying to make the problem go away, Billy G was a problem, but Rick Pition is not ?

    To answer the question as to why UK didnt hire Calamari 2 years ago instead of Bily G.......Because he didnt have all those 5 star recruits lined up! UK bought a basketball team, not a coach.     So called "looser" coaches notwithstanding...it's a far cry worse when talented athletes(which far out
    number the coaches) depart college before graduating. Colleges shouldn't be treated as a playground for molding, shaping and training their atheletes only to see them jump to the NBA - or any other professional sport. When a student athlete accepts a scholarship, grant, stipend or other financial support - then departs for the pros before completing their education - they should be forced to reimburse the colleges from the professional contracts they sign...even if it's done in such a manner that the now pro athlete is allowed to deduct the monies from their income as a donation to charity. College attheltics should not ever be considered a training ground for professional teams

    I just wish that I could get fired from my job and then collect $3,000,000. When coaches walk out on a contract they do not repay the school any money or at least I do not think they do. I would not pay this loser sh!t.

    to jim ... #89 ..... the real shame here is not on society but on the university itself, its board of regents and the ncaa for allowing these schools do act this way ..... what kind of character did kentucky think billy pie possessed when they waited until he signed a contract with Texas A&M to go after him .... screw kentucky and their ethics .... they deserved each other, i just wished he would have gotten it all.

    Billy G. is low rent and does not deserve a penny. But its better that the University just pays him and gets rid of him. Who cares what all the haters say? Kentucky is still number 1 in overall NCAA wins and winning percentage and number 2 in championships, behind only ucla.

    I can't believe a USC fan is criticizing Kentucky in basketball, they ran one of the dirtiest basketball programs in America and still weren't that good. In any case I am glad to be rid of Billie G and I am really excited about coach Cal. I just hope that he isn't the cheat everyone says he is because it would suck to be the first team to 2000 wins and have to vacate them later. But from what I have seen he runs a reasonably clean program, I mean as clean as any other top tier coach in the country.

    All the Kentucky haters....whether we win a title or not this year, just remember all the highlights Wall will put up and move on to have a wicked NBA career. He is the real deal. Should be a awesome season with several top notch teams. Hope no injuries take any of the top teams out of the running. This year's final four should be one for the ages if all plays out right. Go Cats!
