Special prosecutor: No charges in Ark. rape case

LITTLE ROCK, Ark. (AP)—A special prosecutor has decided not to file charges against three Arkansas basketball players accused of rape, citing insufficient evidence.

A university freshman had accused the players of raping her Aug. 27 at a fraternity house party, but local authorities decided against charges. Special prosecutor H.G. Foster was assigned to review the case, but he came to a similar conclusion and disclosed it Friday.

“Based upon the investigation of the University of Arkansas Police Department, tests and reports of the Arkansas State Crime Lab, and other information developed in the case, it is my finding that there is not sufficient evidence to warrant the filing of a criminal charge,” Foster said in a letter to Circuit Judge William Storey.

The players in question—Marcus Britt, Glenn Bryant and Nick Mason— released a statement through attorney John Everett. They said Britt and Bryant voluntarily took and passed polygraph tests in December—and that DNA testing showed the three didn’t commit the acts they were accused of.

Foster declined comment, but a case file provided by the special prosecutor contained a report from the state Crime Lab saying DNA from the three athletes did not match samples from items submitted from a rape kit.

The players were suspended from the team at the beginning of the season for violating unspecified team rules.

“We were guilty of conduct unbecoming of a Razorback student-athlete and have accepted the punishment that came with those actions. However, we did not commit the widely reported acts of which we have been accused,” the players said. “We genuinely believe that we are due an apology from the accuser though we harbor no great expectations of that happening.”

The accuser’s family released a statement through John Bass, its attorney.

“There is a strong and clear need for systemic change in how certain criminal investigations are conducted on the University of Arkansas campus. This is particularly true in cases involving the potential for substantial negative implications for the university’s revenue-generating activities,” the family said.

“The family has exhausted all remedies available to them through the criminal justice system and shall not seek alternative relief.”

The school defended the investigation.

“The family of the accuser has questioned the manner in which the University of Arkansas Police Department conducts investigations. These questions are without basis,” the university said in a statement. “The University of Arkansas Police Department conducted a thorough investigation of this case as reflected by the separate and independent determinations of the Washington County prosecutor’s office and Special Prosecutor H.G. Foster.”

Arkansas athletic director Jeff Long said the school is ready to move forward and that the reputations of the student-athletes “falsely accused should be restored.”

“For the past five months, these young men and our program have been scrutinized in the court of public opinion based primarily upon unsupported allegations and speculation,” coach John Pelphrey said. “I believe that the review conducted by the special prosecutor unequivocally demonstrates that these student-athletes did not commit any crime.”

    Dear Paul from MI,

    In trying to answer your admittance to a lack of understanding and question, to wit:
    "What i don't understand is, if these men were exonerated of any wrong doing, why the hell are they putting their names out there??"

    If by "they" you mean the b-ball players please understand that they were convicted in the press. I do not know enough about the "vicitm", i.e. legal Reps or the "Family Advisor/Spokesman" we see so often nor have I read the local papers or UofA website bit I can imagine these three men suffered quite a bit more than their suspension from the team.

    This, my friends, is why we see and hear from the three student/athletes now that even the rape kit obtained did not link them in the slightest to the vistim getting g-banged. At the very least I would be making statements to the press the yelling from the rafters at the judge and jury treatment I had received for the last 5 months.

What you are to stupid and dumb to realize that there is good and bad in all races including the white race. If you are so unhappy with this country and it's people than just leave, what about Russia, China, Iraq or Iran but please leave and you know what no body not even ONE person will know you have left do not go away mad but just go away and good ridance to bad rubbish

    This is a sad situation, but by rule of law rape did not happen. We have to have faith in our justice system-it may not be perfect but it is one of the best in the world as far as due process is concerned.

    I feel that the main problem is young women acting and dressing like @#$%s and thinking it is what they are supposed to do. What do they think will happen? The sexiest women I have met in my life did not act or dress like little @#$%s. Don't get me wrong, @#$%s can be alot of fun...until they sober up in the morning...

    ....There was Never a doubt....We are talking about Arkansas, Where Women have no Rights.

    Anyone who can drible or pass a ball would never go to prison, where they belong. or even kicked out of school.

    To all the posters with the racist frame of mind,

    You need to be real careful what you say and how you say it in these blogs. That so-called comfort zone you hide behind (your computers) will one day disappear, and one day you may find yourself facing some of the same people on the outside. If you can't muster up the courage to actually say what you feel to someone's face, then why do it here? Keep in mind, the world can be a very small place when it comes to things like this, and one of those blacks, whites, asians, mexicans, etc, that you have so much hatred for, might actually live right next door to you.

    Can we finally close the book on this thing? First, the Fayetteville city prosecutor decided to not file charges, citing lack of evidence. Apparently, the fact that he's related by marriage to Frank Broyles means that some people think that he would risk his job to keep the Hogs out of trouble, so the "victim"'s parents demanded a special prosecutor take over the case. Now, he, too, declines to press charges, citing lack of evidence. There's not enough evidence to say that a rape occured, therefore, by the law, a rape did not occur. In fact, a lack of evidence supporting a rape means that there's more evidence suggesting a rape did not occur.
    This has nothing to do with race, except maybe the closet rapists who say things like "they have to be guilty because they're thugs". Every state has racist people. I lived most of my life in Arkansas, and the most racist place I've ever lived is Urbana, IL, home of the Fighting Illini. Doesn't even compare.

    The only reason you hear about white girls with these problems is because black girls think it is normal to have 3 or more guys forcing themselves on them. Any man who thinks it is ok to take what they want from a woman whether she is drunk, high or whatever is S**t in my eyes. These "college B-ball players" should of been smart enough not to put themselves in the position in the first place. Comments on this thread make me understand why race is still an issue in the south. OOPS I'm late for our local klan meeting! Grow up people!!!!!!

    Rico, you said you "went to school"??? I would really suggest you demand your money back. Just show them your posts and they will realize you have an ironclad case and would gladly give it back. Of course you would have to agree to NEVER specifically identify them as the school you went to.

    Ok, just want to clear up some of the nonsense being spouted in here. I'm from Fayetteville and have followed this story closely. Of the three players under suspicion in this case, two are black and one is white. The girl is white. So we have a mixed race situation. Therefore racism from either direction is misplaced. This isn't about skin color, this is about what happens when ignorant sorority girls let themselves get into bad situations with people they hardly know. Something that happens on every campus in the world. Wherever you are from, I challenge you to look into the statistics related to rapes on any campus you can think of. It happens constantly, and none of you care about it until it involves an athlete. Maybe, since none of us know the facts bout this case, we should just shut up and wait to see how it turns out. And as for you people who seem to think that this is only a sports problem, do you have any idea how many frat boys get away with rape all across the country every single year? It would make you sick to your stomach. J.C. people, I'm from Arkansas, I'm supposed to be the ignorant one. I see alot of naive people talking about things they know nothing about on this thread.

    Racism exist in every state, in every city, in every town and on every block. It's not an Arkansas thing, it's not a southern thing and it's not unique to just the United States. It amazes me how so many of these post see color first and foremost. Being from Arkansas but having not lived there since 1983, I have the distinctive pleasure of seeing MY home state from the outside looking in. Before I left, the state motto was "Thank God For Mississippi" otherwise we would have been at the very bottom. I have seen some great progress over the years and especially the last to to 12 and Arkansas is no longer or near the bottom of every catagory. This includes public displays of racism or racism being taught in the home as a way of life.

    Everyone is innocent until proven guilty regardless.

    Jim M, God Bless Europe? I've been there and lived there, have you? If you like it there so much, move there, otherwise work towards making the country you do live in a better place for all mankind.
